Emil Lederer: Intervention on the Authorizing Authority (1921)

This recorded intervention in official commission proceedings raises a jurisdictional question: who should authorize municipalization when the municipality itself lacks the requisite power?

Eine sehr wichtige und wesentliche Frage wäre die Frage nach der Instanz, welche die Genehmigung in den Fällen zu erteilen hat, in denen die Gemeinde an sich nicht berechtigt ist, Kommunalisierungen vorzunehmen.

English translation: A very important and essential question would be which authority is to grant approval in cases where the municipality itself is not entitled to undertake municipalizations.

Lederer distinguishes municipal competence from authorization by another authority. The intervention identifies this institutional issue as essential but neither names the approving body nor proposes a procedure. Its significance lies in making the allocation of decision-making power an explicit question for the commission.
