Emil Lederer: Exceptions in §§ 2 and 3 (1921)

This recorded commission intervention addresses the scope of expropriation powers under proposed statutory provisions. Lederer identifies two routes by which authorities might authorize expropriations beyond the coverage of the new § 1:

Es soll ausgeschlossen werden erstens, daß die Landeszentralbehörde in Einzelfällen einer einzelnen Gemeinde die Befugnis gibt, kulturelle Institutionen oder landwirtschaftliche Betriebe zu enteignen, welche durch den neuen § 1 nicht gedeckt sind; zweitens soll ausgeschlossen sein, daß die Reichsregierung nach Anhörung des Reichswirtschaftsrats generell diese Verfügung trifft.

English translation: It is to be ruled out, first, that the central state authority grants an individual municipality, in particular cases, the power to expropriate cultural institutions or agricultural enterprises not covered by the new § 1; second, it is to be ruled out that the Reich government, after consulting the Reich Economic Council, issues this authorization generally.

The distinction is between individual municipal authorizations and a general governmental authorization. Lederer then turns this shared restriction into a drafting problem:

Es muß also eine Form gefunden werden, wenn es unsere Absicht ist, daß diese Bestimmung für kulturelle Betriebe auf land- und forstwirtschaftliche Betriebe sowohl in § 2 als in § 3 Anwendung findet.

English translation: A formulation must therefore be found, if that is our intention, under which this provision for cultural enterprises applies to agricultural and forestry enterprises in both § 2 and § 3.

His concern is consistent statutory coverage across both sections and enterprise categories. The conditional phrase leaves the commission’s intention open; the intervention calls for wording that would implement it, without supplying a draft.
