Bei Festsetzung aller Entschädigungen gemäß §§ 10 bis 14 sowie bei Durchführung der Sperrvorschrift des § 5 Abs. 2 sind Umstände des Einzelfalls zu berücksichtigen, soweit sonst unbillige Härten entstehen würden.
English translation: In determining all compensation pursuant to §§ 10 to 14, as well as in implementing the restrictive provision of § 5, paragraph 2, the circumstances of the individual case must be taken into account insofar as inequitable hardship would otherwise arise.
The criterion is not disadvantage alone, but inequitable hardship. Lederer then connects individualized compensation explicitly to implementation of the restriction:
Es sind nicht nur die allgemeinen Vorschriften der Entschädigung anwendbar, sondern im Einzelfall können besondere Umstände berücksichtigt werden, und diese Berücksichtigung der besonderen Umstände soll auch bei der Durchführung der Sperrvorschrift des § 5 Abs. 2 Anwendung finden.
English translation: It is not only the general provisions governing compensation that apply; particular circumstances may also be taken into account in an individual case, and this consideration of particular circumstances is also to apply when implementing the restrictive provision of § 5, paragraph 2.
His example is a prospective entrepreneur who has already made serious preparations, purchased items, or rented premises while economic activity remained unrestricted. Demonstrable preparations, rather than intention alone, supply the grounds for considering the particular case in assessing compensation. The example concerns compensation, not an explicit exemption from the restriction. An interjection calls this self-evident; Lederer disagrees. That closing exchange makes the intervention’s practical point: protection against hardship needs express articulation rather than reliance on assumed administrative fairness.
