Emil Lederer: Demolition Value and Continued Operation (1921)

This recorded intervention in official commission proceedings distinguishes two municipal intentions: demolition and continued operation. If the municipality wants demolition, Lederer allows it to ask the entrepreneur to dismantle the undertaking and receive payment. If it wants continued operation, compensation must not defeat that purpose:

In dem Falle, wo sie selbst es weiter betreiben will, soll der Unternehmer nicht die Möglichkeit haben, durch die Formel „Abbruchswert“ eine solche Entschädigungssumme herauszuschlagen, welche der Gemeinde praktisch dann den Weiterbetrieb finanziell unmöglich macht.

English translation: Where it itself wishes to continue operating it, the entrepreneur should not have the opportunity, through the formula “demolition value,” to extract a sum in compensation that then makes continued operation financially impossible for the municipality in practice.

Lederer’s central move is to judge the valuation formula by its practical consequences. His objection concerns compensation that would render municipal operation unaffordable, rather than compensation as such. The brief intervention thus connects valuation to the feasibility of the municipality’s intended use, without specifying an alternative calculation.
