Emil Lederer: Commission Intervention on Coal Mining (1920)

This recorded commission speaking turn concerns the preparation and discussion of competing proposals for coal mining reform. Lederer’s immediate argument is procedural: proposals should be discussed as they are presented. He reports on the group supporting the Hilferding–Lederer proposal after the preceding plenary session asked it and the group supporting Rathenau’s proposal to meet separately and finalize their submissions.

The intervention distinguishes three elements at different stages of readiness. First, a revised explanatory report incorporates discussion from the previous session. It has reached the commission’s office for duplication, but its distribution remains pending. Second, the group has prepared a legal formulation:

Zweitens liegt vor eine juristische Formulierung des Vorschlags vom vorigen Jahr, ergänzt durch einige Abänderungen, welche für richtig erachtet wurden.

English translation: Second, there is a legal formulation of last year’s proposal, supplemented by some amendments that were considered appropriate.

Lederer treats this text as available for distribution and potentially ready for immediate discussion, while leaving that decision to the commission. His distinction between an explanatory report and a legal formulation separates the justification of reform from its proposed legal expression.

The third element concerns labor relations and workers’ representation:

Drittens ist gestern in einer engeren Besprechung noch die Frage der Arbeitsverhältnisse und der Arbeitervertretungen — Zechenrat und der ganze Aufbau der Zechenräte — in eine etwas andere Form gebracht worden, als es in der ersten juristischen Formulierung vorgeschlagen wurde.

English translation: Third, in a smaller meeting yesterday, the question of labor relations and workers’ representative bodies—the pit council and the entire structure of the pit councils—was given a somewhat different form from that proposed in the first legal formulation.

This revision shows that arrangements for workers’ representation remained open even after a legal draft existed. Since the new text has not yet been duplicated, Lederer offers to present its principles orally. The passage’s significance lies in this account of reform taking shape through successive deliberations, documents, and revisions. It identifies the institutional questions under discussion but does not explain the competing proposals’ substantive provisions or specify how the pit councils would operate.
