Emil Lederer: Intervention on Coal Mining (1920)

This recorded commission speaking turn addresses the legal route for redeeming mining regalian rights. Lederer begins from a procedural constraint: the law will not be published immediately, leaving an interim declaration as the available response. He proposes its substantive position:

Da würde uns nur eine Zwischenerklärung übrigbleiben, dahingehend: da die Ablösung der Regale eine Frage ist, die die Sozialisierung des Bergbaus wesentlich tangiert, so geben wir unsere Stellung dahin aus, daß diese Maßnahme durch Reichsgesetzregelung durchzuführen wäre.

English translation: In that case, only an interim declaration would remain open to us, to the following effect: since the redemption of regalian rights is a question that substantially affects the socialization of mining, we state our position that this measure should be implemented through legislation at Reich level.

The intervention links mining socialization to legislative jurisdiction. Lederer then qualifies his proposal: as far as he can see, it entails a constitutional amendment. The turn thus moves from a temporary procedural response to a substantive institutional difficulty, identifying constitutional change as a possible requirement without developing a broader programme of socialization.
