Er hat tatsächlich nicht einzugreifen, sondern, wie die letzten Bestimmungen des Entwurfs vorschlagen, sind dafür bestimmte Institutionen vorhanden, die Betriebsleitung und die Arbeiter- und Angestelltenvertretungen.
English translation: It is in fact not to intervene; rather, as the final provisions of the draft propose, specific institutions exist for this purpose: management and the representatives of workers and salaried employees.
The turn moves from the rationale for clarification to the allocation of authority, then names the council’s limited role:
Der Reichskohlenrat hat nur von den Vereinbarungen Kenntnis zu nehmen. Es ist also eine negative Kompetenz.
English translation: The Reich Coal Council is only to take note of the agreements. It is therefore a negative competence.
“Negative competence” makes the provision a boundary on intervention. Lederer closes by stating that all the council’s powers are enumerated at this point. The contribution’s significance lies in this precise institutional distinction, not in a broader programme for coal mining.
