Emil Lederer: Commission Intervention on Coal Mining (1920)

This extracted commission speaking turn consists of Lederer reading §§ 11–12 of a proposed institutional arrangement for coal administration. Its substance is the division of authority between the Reich Coal Council (Reichskohlenrat) and the Reich Coal Directorate (Reichskohlendirektorium). Lederer offers no separate argumentative commentary; the provisions themselves articulate a model of executive discretion within representative oversight.

Section 11 makes the Directorate responsible for administering the German Coal Community under an annually submitted budget and the Council’s procedural rules:

Das Reichskohlendirektorium führt die Geschäfte der Deutschen Kohlengemeinschaft auf Grund eines alljährlich beim Reichskohlenrat einzubringenden Haushaltsanschlages und nach Maßgabe der Geschäftsordnung des Reichskohlenrats.

English translation: The Reich Coal Directorate conducts the affairs of the German Coal Community on the basis of a budget estimate to be submitted annually to the Reich Coal Council and in accordance with the Reich Coal Council’s rules of procedure.

This supervisory framework nevertheless must permit effective, independent management, including unforeseen necessary expenditure. The Directorate also appoints district heads and, after consultation with them and the works committee, managers of mines and other operations. Consultation thus qualifies, but does not replace, executive appointment authority.

Section 12 gives the Directorate five members, elected by the Council for five years, without requiring Council membership. Fixed terms and eligibility for reelection coexist with a continuing power of removal:

Sie können jederzeit durch einen mit zwei Drittel Mehrheit nach Maßgabe der Geschäftsordnung zu fassenden Beschluß des Reichskohlenrats abberufen werden.

English translation: They may be removed at any time by a resolution of the Reich Coal Council adopted by a two-thirds majority in accordance with its rules of procedure.

The institutional balance is therefore neither unrestricted executive autonomy nor direct Council management. Operational independence remains answerable to budgetary rules, appointments, and qualified-majority dismissal. The final sentence assigns fixed remuneration specifically to Council members. As a brief legislative intervention, the passage documents how centralized coal administration was to reconcile managerial effectiveness with accountable governance.
