Emil Lederer: Discussion contribution on the potash industry (1921)

This recorded commission speaking turn addresses how an advisory opinion should formulate compensation for workers affected by operational restrictions in the potash industry. Lederer frames the issue as a choice between stating a general standard and specifying a measurable improvement:

Ich glaube, daß es nur zwei Möglichkeiten gibt; entweder einigt man sich auf einen allgemeinen Ausdruck, daß man sagt: angemessen entschädigt; oder man entschließt sich dazu, eine gewisse Verbesserung gegenüber der Entschädigung bei heutiger Betriebseinschränkung vorzuschlagen, etwa statt 12 Wochen 24 Wochen Unterstützung.

English translation: I believe there are only two possibilities: either agreement is reached on a general expression, saying: adequately compensated; or a decision is made to propose a certain improvement over compensation under present operational restrictions, for example 24 weeks of support instead of 12 weeks.

Doubling the support period is an illustrative proposal, not a settled demand. Lederer questions whether an advisory opinion needs such a detailed provision. His alternative gives “adequate” compensation substantive content through a comparison with other industries:

Wenn man sagt: angemessene Entschädigung, die die speziellen Zustände in der Kaliindustrie berücksichtigt, die über die sonst gewährte Entschädigung bei Betriebseinschränkungen in anderen Industrien hinausgeht, so dürfte das vielleicht genügen, um anzudeuten, daß wir 12 Wochen Unterstützung nicht für ausreichend halten.

English translation: If one says: adequate compensation that takes account of the particular conditions in the potash industry and exceeds the compensation otherwise granted for operational restrictions in other industries, that might perhaps suffice to indicate that we do not consider 12 weeks of support sufficient.

The intervention thus distinguishes precision about duration from clarity about principle. Its significance lies in this drafting move: a flexible recommendation can still reject the existing twelve-week provision as insufficient, without prescribing an exact replacement period.
