Somary’s brief review judges Derblich’s 1903 monograph by the distinction between collecting legal materials and producing legal scholarship:
Dem Verfasser mag zur Entschuldigung dienen, daß er für das österreichische Versicherungsrecht so gut wie gar keine Vorarbeiten hatte, wenn wir von seinen beiden früheren Monographien absehen; immerhin hätte man bei dem gegenwärtigen Stande der österreichischen Jurisprudenz auf eine bessere Bearbeitung des Versicherungsrechtes vollen Anspruch; denn die Derblichsche Monographie steht auf dem Niveau eines schlechten Seminarvortrages: das Gesetz- und Verordnungsmaterial ist fleißig gesammelt, die eigenen Gedanken des Autors hätten uns erspart bleiben können.
English translation: It may serve as an excuse for the author that for Austrian insurance law he had virtually no preliminary studies at his disposal, if we leave aside his own two earlier monographs; nevertheless, given the present state of Austrian jurisprudence, one would have had every right to a better treatment of insurance law; for Derblich's monograph stands at the level of a poor seminar paper: the statutory and regulatory material has been diligently collected, the author's own thoughts might have been spared us.
The initial concession gives way to criticism of confused organization and a section on French insurance literature reduced to aphorisms. Somary’s closing judgment states the scholarly standard these failings violate:
Keine Spur von systematischem Aufbau oder juristischer Durchdringung der allerdings schwierigen Materie.
English translation: Not a trace of systematic construction or of juristic penetration of the admittedly difficult subject matter.
The review’s relevance lies in this demand for systematic legal analysis: scarce precedents and a difficult subject explain obstacles, but do not excuse substituting compilation and quotations for conceptual work.
